Abstract
Abstract Chapter 4 discusses the province of Punjab and its resistance of the conservative turn on land tenures in post-Mutiny British India because of the agency of John Lawrence, now the Governor-General of India. He and the administrators of the ‘Punjab School’ ensured the legalisation of substantial proprietary rights for many tenants in the 1868 Act. Furthermore, the Punjab School used the post-1857 emphasis on protecting local customs to its advantage by foregrounding customary land tenure rights before the advent of British rule. It received additional support from Henry Maine, a law member on the governing council of British India at the time, and his ideas on early institutions and communal property rights. The Punjab Act was a salient piece of legislation as it established peasant proprietorship (which incorporated the ‘three Fs’: fixity of tenure, fair rents, and freedom of sale) by overcoming strong opposition in India and England and foregrounding customary rights as a viable rationale to legalise peasants’ security of tenure.
