En este artículo se analizan los alcances del derecho a la educación a la luz del rol del poder judicial en el Estado federal argentino. En primer lugar, se realiza una conceptualización del federalismo, y de la organización del sistema judicial en función de las bases constitucionales de Argentina. En segundo lugar, se caracteriza el sistema de protección de derechos a la luz del rol del poder judicial en lo que atañe al control de constitucionalidad y convencionalidad en materia del derecho a la educación. Se considera también el impacto del derecho internacional de los derechos humanos en el derecho local. Finalmente, se analizan algunos fallos relevantes para comprender los alcances, limitaciones y desafíos que evidencia el accionar el poder judicial en un Estado federal, en su tarea de garantizar el reconocimiento del derecho a la educación, de su contenido y alcance en la vida cotidiana, cuando es ejercido.
