La maltraitance et le harcèlement des personnes vieillissantes dans le parc locatif privé au Québec

Abstract
Ce texte présente les résultats préliminaires d’une étude en cours portant sur l’efficacité des recours existants pour les locataires âgé·es qui subissent de la maltraitance et du harcèlement dans le cadre d’une relation locative avec un·e propriétaire. Après un examen conceptuel de la notion de précarité résidentielle, nous proposons un examen critique de la Loi pour contrer la maltraitance envers les aîné·es pour montrer qu’elle ne couvre pas les relations locatives entre propriétaires et locataires. Nous montrons également, par une analyse succincte, le très faible recours à l’article 1902 du Code civil du Québec, portant sur le harcèlement envers les locataires. Finalement, l’article ouvre sur une réflexion sur le laisser-faire généralisé concernant la violence exercée par des propriétaires envers des locataires vieillissant·es.
