L’expertise psychologique et psychosociale (EPP) en matière familiale est un élément de preuve apprécié par les avocats et utile à la résolution des litiges. Or, aucune étude québécoise ne s’est intéressée au point de vue des avocats sur l’EPP et sur l’utilisation qu’ils en font. Dans l’étude présentée ci-dessous, onze avocats pratiquant en matière familiale et ayant recours à l’EPP ont participé à des entretiens de groupe focalisés. L’analyse des entretiens permet de documenter le contexte entourant le recours à l’EPP, les retombées attendues par les avocats, leurs attentes quant aux conduites et aux compétences des experts ainsi que les enjeux qui concernent autant les familles visées que la saine administration de la justice familiale. Les résultats mettent en lumière l’apport notable de l’EPP au travail des avocats. Toutefois, l’étude révèle que certains enjeux relatifs à l’EPP risquent de compromettre l’accès à la justice des familles considérées et de nuire à la qualité du service qui leur est offert.
