Abstract
L’État libéral laïque fondé sur le droit rationalisé postule la possibilité de séparer le politique d’un domaine dit religieux, avec lequel il romprait à tous égards. Si l’État libéral peut réglementer le religieux sous son aspect externe, il demeure que cet État continue de s’occuper de choses sacrées, de les nommer, et même d’en entretenir le culte diversement. En ce sens, le sacré déborde le religieux appréhendé par les catégories du droit étatique. De plus, l’État contemporain libéral se sacralise par divers moyens. C’est pourquoi il se tient au bord du sacré, qu’il s’agisse du sacré religieux dont il s’imprègne ou d’un sacré civique ou antérieur à l’émergence du christianisme, dont on peut observer les manifestations dans le droit lui-même, les rituels institutionnels, l’intangibilité prêtée aux frontières étatiques, et même l’institution de la représentation politique, dont la sociologie et la théorie du droit ont souligné la portée « totémique ».
