Abstract

Among practitioners of criminal analysis, there is disagreement regarding the object matter being examined and the use made of its results. Therefore, from the logical empiricist, the synthetic method and analytical research, is questioned the referent of the word "criminal analysis," which is assumed to be used uncritically. The general objective is to identify the referent of criminal analysis applicable in criminal proceedings. To this end, components related to criminal analysis are recovered, then a pre-analytical complex of the referent is constructed, and the conditions of applicability are described. Among the findings, it is notable that the analyzable object is the content of a criminal case, whose factual conclusions are distributed by an expert witness at trial. In conclusion, the mixed procedural system with an accusatory tendency is the broadest environment in which the conditions of applicability of criminal analysis are established.
