Abstract
Comment considérer le corps en situation muséale par rapport au droit commun? Comment est‑il possible qu’il puisse faire l’objet de patrimonialisation ou plus exactement qu’il puisse être juridiquement approprié par une personne publique, à l’instar d’un musée, et tomber ainsi dans le patrimoine commun en tant qu’élément de la domanialité publique? Cette domanialité, qui implique l’inaliénabilité (entre autres) et qui protège les biens de la collectivité, parmi lesquels les objets muséaux, s’applique‑t‑elle en toutes circonstances, de manière stricte et absolue? Peut‑elle céder, en certaines situations, tout particulièrement lorsqu’il s’agit d’éléments du corps humain dont la nature est si particulière?
