Abstract
Abstract Native peoples have long defended their existing political rights as the expression of fair treatment based on an extensive record of treaty-making with settler states. This chapter argues that both the United States and Canada base their claims to political status on similarly historicized principles. It argues that non-ideal theorists have good reasons to insist on distributive consistency in these circumstances, in which the political rights of Native nations are defended on the same grounds as the historically based claims of the United States and Canada. It considers whether similar historically based principles would be necessary for the distribution of political rights in a more ideal world, and argues that they would indeed be so required. Seen in this light, the chapter argues that there is nothing normatively anomalous about historically grounded Native political rights, which fit naturally into our world’s deep distributive practices.
