Abstract
La prisión preventiva en Ecuador constituye la privación de la libertad ambulatoria que el Juez de Control aplica de manera excepcional al acusado de un delito en situaciones de necesidad extrema, siendo una es una medida cautelar dentro de los procesos penales. El objetivo de este estudio fue analizar la situación socio jurídica que acarrea la aplicación indebida de la prisión preventiva en materia penal, esto a través de una revisión bibliográfica y normativa en su modalidad cualitativa con métodos analítico sintético, de hermenéutica y exegética jurídica necesarios para la interpretación de preceptos constitucionales y de leyes secundarias relacionadas a la prisión preventiva. Los resultados mostraron evidencias que el uso indebido de la prisión preventiva como medida cautelar no cumple con el principio de última ratio, y se vuelve desproporcional en su aplicación, y que a partir de la resolución emitida por el pleno de la Corte Nacional de Justicia.
