Au Québec, le droit régissant les violences à caractère sexuel dans le cadre du travail est fortement morcelé. De telles violences constituent une atteinte au droit à l’égalité des femmes et des personnes issues de la diversité sexuelle et de genre. En même temps, elles sont susceptibles de causer une atteinte à la santé et à la sécurité des travailleuses et travailleurs, ainsi que de constituer une violation de leur droit à un milieu de travail exempt de harcèlement psychologique. Pour donner suite aux constats d’un Comité d’expertes chargé d’analyser les recours en matière de harcèlement sexuel et d’agressions sexuelles au travail, en 2024, l’adoption de la Loi visant à prévenir et à combattre le harcèlement psychologique et la violence à caractère sexuel visait à améliorer le régime de prévention ainsi que la cohérence et l’efficacité des recours pour les personnes victimes. Même si cette réforme renforce à certains égards la superposition de régimes distincts, par sa perspective conjuguée de transformation structurelle et de réparation pour les personnes victimes, elle représente une avancée significative dans la lutte contre les violences à caractère sexuel dans le cadre du travail.
