Abstract
Abstract The chapter first considers the concept of a condition in the law of contract, and its variety of meanings, addressing its principal modern usage in the context of elective discharge or termination in response to a qualifying breach of contract. It analyses the process for categorizing provisions as conditions, warranties, and intermediate terms. Secondly, it considers the concept of a warranty and a similar variety of meanings in particular contexts. It considers the test for differentiating representations and warranties, and the concept of collateral warranties. Thirdly, it addresses the concept of an indemnity, including indemnities in the context of insurance and guarantees. It also considers the construction issues and the residual role of the Canada Steamship guidelines.
