Abstract
Les règles, pratiques et conduites que doivent respecter les juges constitutionnels sont l’objet de la présente recherche. La notion de l’obligation comportementale propose de réunir l’ensemble de ces contraintes pesant sur les juges constitutionnels. Elle constitue un outil de compréhension, d’identification et d’analyse nouveau de ces différentes règles indépendamment de leur formalisation et de leur degré de contrainte. L’analyse empirique et comparatiste de l’obligation comportementale ainsi que des processus destinés à la garantir, opérée au sein du Conseil constitutionnel, de la Cour constitutionnelle de Belgique, de la Cour suprême du Canada, du Tribunal constitutionnel fédéral allemand et du Tribunal constitutionnel espagnol, met en lumière la proximité des règles observées par des juges appartenant à des juridictions constitutionnelles différentes. Elle souligne également le caractère commun des processus comportementaux entre ces juridictions. Enfin, elle pousse à repenser le rôle des différents juges au sein de la juridiction constitutionnelle, offrant une dimension nouvelle à la collégialité ainsi qu’au rôle du président de la juridiction constitutionnelle.
