Abstract
Con la aprobación de la Ley Orgánica 1/2018, de 5 de noviembre, de reforma del Estatuto de Autonomía de Canarias (EACan), se han producido importantes cambios en la materia de las costas y de las aguas que la rodean, tanto en lo referente a la asunción de competencias por parte de la Comunidad Autónoma (CA), como a la propia configuración del ámbito espacial de las Islas Canarias que trasciende del territorio al aquitorio, al trazarse, en dicho Estatuto, un contorno perimetral entre los puntos extremos más salientes de las islas e islotes que integran, y englobar el espacio marítimo que se integra dentro de esas líneas como “aguas canarias” y como competencial ámbito marítimo de la Comunidad. Conforme al nuevo Estatuto el ejercicio de las competencias estatales o autonómicas sobre las aguas canarias y sobre los restantes espacios marítimos que rodean a Canarias sobre los que el Estado español ejerza soberanía o jurisdicción, se realizará teniendo en cuenta la distribución material de competencias establecidas constitucional y estatutariamente tanto para dichos espacios como para los terrestres. Este artículo estudia la nueva configuración del régimen de costas y del espacio marítimo.
