La privación de la patria potestad requiere que los progenitores incumplan sus deberes de forma grave y reiterada, así como que sea beneficiosa para el hijo. La causa más frecuente de privación de patria potestad es la de ausencia de contacto del progenitor con el menor cuando no se ha interesado por su situación ni sus necesidades. El reconocimiento de un menor no exime automáticamente al progenitor de la posible privación de la patria potestad si este incumple gravemente sus deberes parentales. Los incumplimientos del progenitor deben ser graves, reiterados y, prolongados en el tiempo, haciendo dejación total de sus funciones tanto en lo afectivo como en lo económico, y sin causa justificada, afectando a la relación paterno-filial de manera seria y justifica. La patria potestad es una función con un amplio contenido, no un mero título cualidad, de ahí que se mantenga la incompatibilidad entre mantener la potestad y, a la vez no ejercer en beneficio del hijo ninguno de los deberes inherentes a la patria potestad. Su privación, sea temporal, parcial o total, requiere, de manera ineludible, la inobservancia de aquellos deberes de modo constante, grave y peligroso para el beneficiario y destinatario de la patria potestad, el hijo.
