Abstract
El nombre y apellidos configuran la identidad de las personas. El primer apellido que se impone a los bebés al nacer suele ser el más utilizado en las relaciones académicas y sociales, y, por esta razón, el orden del apellido que se impondrá —del padre o de la madre— puede revestir una notoria importancia. En este artículo examinaremos la actual normativa del Registro Civil en materia de filiación, favoreciendo nuestro ordenamiento la igualdad de los progenitores a la hora de elegir qué apellido debe ir en primer lugar, haciendo una llamada al acuerdo utilizando cualquier herramienta que permita la elección sin discriminación, evitando así, que un extraño, como es el Encargado del Registro Civil, elija por ellos. Analizaremos también, cómo el otorgamiento de capitulaciones matrimoniales puede ser útil para resolver este asunto para el futuro. Con este trabajo no se busca favorecer el establecimiento de un apellido sobre el otro, sino que ambos padres, en plano de igualdad, tienen idéntico derecho a fijar el suyo tras un diálogo franco y sincero. El que las estadísticas aún no reflejen un cambio radical en el establecimiento del apellido materno no significa que el tema deba conocerse en todos los ámbitos y no perpetuar por costumbre una prevalencia que no se ajusta al actual sistema legal. La igualdad es uno de los fundamentos irrenunciables de la Constitución Española, por eso, todos los procesos que vayan dirigidos a conseguir una igualdad real entre los sexos deben ser aplaudidos.
