El matrimonio es la unión estable entre dos personas, del mismo o de diferente sexo, establecida conforme a los requisitos previstos en la legislación civil. En España la formalización del matrimonio puede realizarte por la vía civil o la eclesiástica, pero ambas tienen en común la necesidad de que se otorgue el consentimiento en el marco del negocio jurídico matrimonial como declaración de voluntad que sea manifestada por los contrayentes, con el fin de celebrar el matrimonio válidamente. Por ello, el consentimiento de los cónyuges es un elemento esencial del matrimonio y si el mismo se celebra sin este elemento será inválido. Se establecen las causas de nulidad matrimonial en el Código Civil donde se incluye el hecho de que el matrimonio se haya celebrado sin consentimiento matrimonial. En el caso analizado, el hecho de que uno de los contrayentes tuviera un deterioro significativo que lo hiciera incapaz de gobernarse a sí mismo, lo convertía igualmente en incapaz para consentir el matrimonio, y, todo ello, junto con el hecho de que fue modificada la capacidad del contrayente a los pocos meses de la celebración del matrimonio, en un procedimiento iniciado antes de dicha celebración.
