La excepción a la representación legal de los hijos menores por parte de los padres (art. 162 CC) solo se aplica cuando hay un conflicto real de intereses. Este conflicto se define por la existencia de una situación en la que los intereses del representante (progenitor) tienen una ventaja significativa sobre los del representado (menores). En otras palabras, la excepción no se activa por la mera posibilidad de un conflicto hipotético, sino cuando se puede demostrar un detrimento directo y tangible a los intereses del menor. Se excluye del supuesto previsto por la norma el mero peligro hipotético o la mera suposición de que pudiera concurrir un supuesto de conflicto si se dan circunstancias no acreditadas en el expediente de que trate. Por otro lado, la valoración de inexistencia de conflicto no puede hacerla por sí mismo el representante del menor o de la persona con discapacidad, sino que exige el nombramiento de un defensor judicial.
