Abstract
Las líneas que siguen están dedicadas a tratar distintos aspectos de la competencia judicial para conocer de una solicitud de medidas cautelares por infracción de patente si con anterioridad se ha presentado un escrito preventivo. En particular, trataré de demostrar que, si en la solicitud se pide que las medidas se adopten sin previa audiencia del demandado, la competencia corresponde al tribunal ante el que se hubiera presentado el escrito preventivo. Asimismo, trataré de demostrar que esa competencia corresponde a cualquier otro tribunal competente para conocer del proceso de infracción si la solicitud de medidas cautelares pide que sean adoptadas tras la celebración de vista para la audiencia de las partes. Finalmente, sostendré que, formado el procedimiento de medidas cautelares como consecuencia de un escrito preventivo, la solicitud de medidas cautelares
