Abstract
Le 29 mai 2024, l’Assemblée nationale du Québec a adopté le projet de loi no 53, Loi édictant la loi sur la protection contre les représailles liées à la divulgation d’actes répréhensibles et modifiant d’autres dispositions législatives. Le projet de loi confie des responsabilités accrues au Protecteur du citoyen et une diversification de ses pouvoirs, que ce soit au niveau du traitement des divulgations des lanceurs d’alerte, de la protection contre les représailles, ou de la prévention et de la sensibilisation liées à ces enjeux. À la lumière de cette réforme, il devient utile de s’interroger sur les impacts potentiels des changements législatifs sur la protection des lanceurs d’alerte au Québec. L’objectif de ce texte est d’apporter des réflexions praticiennes sur la réforme du régime de protection des lanceurs d’alerte, ainsi que sur la mise en œuvre de l’encadrement législatif concernant l’intégrité publique par le Protecteur du citoyen.
