Abstract
Depuis 2012, les militaires qui divulguent des actes répréhensibles sont protégés par un régime analogue, mais distinct de celui applicable aux fonctionnaires du Canada. Or l’environnement éthique dans lequel les membres des Forces armées canadiennes (FAC) évoluent est complexe, changeant, et a fait l’objet d’examens externes qui en ont montré des failles. Alors que s’opère un changement de culture au sein des FAC, la loi du silence y serait toujours tenace. Le présent texte propose de faire un état des lieux, tant sur le plan de l’infrastructure juridique que de la doctrine en matière d’éthique, pour mieux comprendre comment s’opère la protection des lanceurs d’alerte militaires. Ce texte invite à la réflexion alors que le régime général applicable aux fonctionnaires fait l’objet de critiques. Il propose des pistes de réforme.
