Entre encadrement et invisibilisation : les trajectoires des femmes dans les tribunaux de santé mentale

Abstract
Cet article analyse les trajectoires judiciaires de femmes ayant participé à un Programme d’accompagnement justice-santé mentale (PAJ-SM). L’étude examine la manière dont ces dispositifs traduisent les vulnérabilités des femmes en catégories d’intervention, en se centrant notamment sur les diagnostics psychiatriques, les conditions judiciaires imposées, les objectifs d’intervention et les taux de récidive. Cette étude repose sur une analyse comparative de 988 dossiers judiciaires provenant de 10 tribunaux de santé mentale au Québec, sélectionnés selon un échantillonnage stratifié, et intègre des données judiciaires et policières afin de comparer les trajectoires des femmes et des hommes judiciarisés dans ces dispositifs. Les résultats révèlent une forte surreprésentation des diagnostics de trouble de la personnalité limite chez les femmes, une tendance à la standardisation des plans d’intervention, ainsi qu’un encadrement fondé sur des logiques de responsabilisation individuelle. Loin d’être neutres, ces dispositifs mobilisent des attentes comportementales genrées, valorisant l’adhésion, la stabilité et la collaboration, tout en invisibilisant les contextes de précarité, de victimisation ou de violence structurelle. Ce travail met en lumière les tensions entre soin et contrôle, et souligne la nécessité d’une plus grande sensibilité aux rapports sociaux de genre dans l’évaluation et l’adaptation des pratiques judiciaires dites thérapeutiques.
