Abstract

In Quebec, the law governing sexual violence in the workplace is highly fragmented. Such violence constitutes a violation of the right to equality of women and persons of diverse sexual and gender identities. At the same time, it can harm the health and safety of workers and may violate their right to a workplace free from psychological harassment. In response to the findings of an Expert Committee tasked with analysing recourse for sexual harassment and sexual assault at work, in 2024, the adoption of the Act to prevent and combat psychological harassment and sexual violence at work aimed to improve the prevention regime and the consistency and effectiveness of avenues of recourse available to victims. Although this reform in some respects reinforces the overlap of the various regimes, through its combined focus on structural transformation and remedy for victims, it represents a significant step forward in the fight against sexual violence in the workplace.
