Abstract
Adjudicators must balance the potential risks of admitting expert evidence and decide whether they are outweighed by the potential benefits. In Canada, expert evidence is only admissible if it meets certain threshold criteria and if the adjudicator believes admitting the evidence will do more good than harm. Nonetheless, the legal system has remained vulnerable to flawed expert testimony prompting courts to tighten admissibility requirements and reinforce the judge&s;s gatekeeping role. This chapter considers how these judicial gatekeeping enhancements have been applied to expert social science evidence and discusses their potential implications for forensic linguists who work as expert witnesses.
