Abstract
« Un procès pour l’histoire ». L’expression est aujourd’hui devenue un lieu commun des analyses des « grands procès », ceux qui, pense-t-on, réordonnent, rétablissent ou réparent un traumatisme collectif. Faire l’histoire ou faire mémoire serait une fonction à part entière de la justice advenue avec les procès tardifs pour crimes contre l’humanité. Les mois qui suivent la fin des combats sont encombrés de procès historiques ou pour l’histoire car il s’agit bien, alors, de réparer l’histoire, de rétablir la chaîne des temps en imposant une représentation rétrospective commune d’un passé proche qui a bouleversé les ordres établis et les certitudes. Imposer une vision commune de ce passé pour inscrire le présent dans une légitimité historique.Dans cette contribution, nous voudrions analyser la fonction historique des procès Pétain et Laval en interrogeant le rôle de la justice dans l’écriture ou la réécriture de l’histoire.
