Abstract
Abstract This chapter examines the general structure of the Constitution of Japan of 1946 and the notable characteristics of Japan’s current constitutional system. On paper, the 1946 Constitution establishes liberal democracy under Westminster-style government, but Japan’s actual implementation and enforcement of this form of government are very unique. Distinctive features of the current system include a peculiar policy-making style (in which bureaucracies are dominant and the legislature is marginalized), conflicting views on article 9, the pacifism clause (which renounces war and prohibits the maintenance of armed forces), and the very conservative nature of the Japanese Supreme Court’s constitutional jurisprudence with respect to enforcement of article 9 as well as individual rights.
