Confrontando Stati Uniti, Canada, Gran Bretagna, Francia, Italia e paesi scandinavi l’articolo evidenzia come la scelta contrattuale o extracontrattuale di tutela del paziente sia indifferente, in quanto le corti in tutte le varie giurisdizione – con l’eccezione di quella inglese – tendono a risolvere uniformemente i casi sottoposti, spostando, attraverso varie tecniche di decisione l’onere della prova in capo alla struttura sanitaria e al medico, attribuendo così una più ampia tutela al paziente. L’articolo evidenzia anche la relazione fra sistemi di responsabilità e sistemi indennitari e la loro diffusione in Europa.
