Abstract
Notre recherche s’intéresse au traitement réservé par les tribunaux aux normes musulmanes invoquées dans le cadre de litiges familiaux et, plus particulièrement, aux méthodes employées pour reconnaître ou évincer une norme étrangère. Dans le cadre du présent article, l’intervention de la notion d’ordre public tel qu’il est entendu dans les relations internationales sera abordée. Comme en France, afin d’assurer le respect des valeurs fondamentales de la société, ce standard permet aux juges québécois de refuser d’appliquer une loi étrangère ou de reconnaître une décision issue d’une autre juridiction. Ainsi, nous verrons que l’ordre public s’oppose parfois à la reconnaissance de décisions étrangères qui, fondées sur une loi considérée discriminatoire, ont pour effet de rompre le lien matrimonial. L’usage de cette notion soulève toutefois certaines difficultés que nous entendons aborder.
