Die Geschichte der europäischen Besiedlung des späteren Kanadas beginnt Mitte des 16. Jahrhunderts mit den Entdeckungsfahrten von Jacques Cartier. 1583 nahm Sir Humphrey Gilbert einen Teil des späteren Neufundlands für die britische Krone in Besitz. Es folgten weitere Expeditionen etwa von Samuel de Champlain Anfang des 17. Jahrhunderts, welche 1608 zur Gründung der Kolonie Québec führten. 1669 kam es durch die Gründung der Hudson’s Bay Company zu einer Intensivierung des Kolonialwettbewerbs zwischen Frankreich und Großbritannien. Nach einer Reihe von kriegerischen Auseinandersetzungen zwischen französischen und britischen Verbänden im 18. Jahrhundert endete das Engagement Frankreichs mit dem Frieden von Paris 1763. In den folgenden Jahren kam es zu einer stetigen Zuwanderung britischer Bürger in die nunmehr britischen Kolonien. Nachdem Versuche der Assimilation der frankophonen Bevölkerung gescheitert waren, verabschiedete das britische Parlament 1774 den Quebec Act, der die Sonderrolle Québecs im britischen Einflussbereich anerkannte. Unter anderem wurde mit dem Gesetz das Weiterbestehen der französischen Code-civil-Tradition festgelegt.
