Abstract
« Dans son ouvrage le Vocabulaire juridique, le professeur Cornu relève trois sens au terme minorité. Le premier, référant à la minorité de la personne, doit immédiatement être écarté. Restent les deux autres. L’un vise la minorité dans une assemblée délibérante ou, pourrait-on ajouter, dans tout corps déterminé et réfère au groupe qui, inférieur en nombre, ne peut en principe pas contrôler les destinées de ce corps constitué; tel est, par exemple, le cas de l’actionnaire ou du copropriétaire minoritaire. L’autre sens est celui qui intéresse tout particulièrement le droit international et les libertés publiques et réfère à un « [g]roupe d’individus […] qui forme une véritable communauté caractérisée par ses particularités ethniques, linguistiques et religieuses et se trouve en état d’infériorité numérique au sein d’une population majoritaire vis-àvis de laquelle elle entend préserver son identité » […] ».
