Abstract
Ship-source oil spills can cause significant harm to the marine environment. When an oil spill occurs near national boundaries, legal issues and international considerations can become complex if the oil slick spreads due to natural phenomena such as weather, tidal currents, and sea conditions. This article focuses on the Pacific boundary at the 49th parallel between the United States and Canada. It first presents two significant cross-border pollution incidents and provides an overview of pollution prevention legislation in both countries. Following that is a discussion of cooperative agreements regarding cross-border oil pollution between the United States and Canadian federal governments, as well as the regional governments of Washington State and British Columbia. Compensation and response funding comparisons are made, and recent initiatives to improve prevention and response are included in the article.
