Abstract
A falta de eficácia das decisões judiciais, devido aos mais diversos entraves à celeridade processual, é um dos principais fatores que contribuem para o diagnóstico de crise do processo civil brasileiro. Conseqüência disso, o Código de Processo Civil tem sido objeto de inúmeras reformas, visando dar-lhe maior dinâmica, agilidade, bem como maior segurança aos direitos dos cidadãos. Dentre elas, o presente trabalho exalta a estabelecida pela Lei n° 11.232/2005, a qual reestruturou o processo de execução dos títulos executivos judiciais referentes às obrigações de dar. Dentre as principais inovações, destacam-se o fato de a execução deixar de ser realizada por uma ação autônomo posterior ao processo de cognição para tornar-se uma fase processual, chamada de cumprimento da sentença, além da extinção dos embargos como meio de defesa, surgindo a figura da impugnação à execução. Este meio de defesa será o objeto principal do presente estudo, no entanto, este novo instituto processual não possui a amplitude suficiente para assegurar por completo os direitos garantidos aos executados, motivo pelo qual, ainda persistem no direito outros meios capazes de afastar um processo executivo indevido, tais como a exceção de pré-executividade e a defesa heterópica.
