El Tribunal Suprem del Canadà ha dictat recentment un dictamen consultiu sobre quin procediment de reforma constitucional és aplicable a la reforma del Senat canadenc. Aquest article ofereix una perspectiva històrica que explica el desenvolupament de les normes que regeixen les esmenes constitucionals respecte del Senat i els orígens de la controvèrsia, la qual ha estat sotmesa al Tribunal. Per resoldre aquesta qüestió, el Tribunal Suprem ha hagut d’explicar, per primera vegada des de l'adopció de la constitució de 1982, la seva interpretació de la fórmula d’esmena constitucional. Basant-se en el concepte d'«arquitectura constitucional» i, implícitament, en una visió de la federació canadenca com a pacte, el Tribunal ha prohibit al govern federal d’actuar de manera unilateral. La reforma del Senat, en cas que s’hagi de dur a terme, implicarà, doncs, que hi hagi d’haver una entesa entre el govern federal i les províncies. Qui peut réformer le Sénat canadien? La Cour suprême du Canada a récemment rendu un avis consultatif portant sur la procédure de modification constitutionnelle applicable à la réforme du Sénat canadien. Le présent texte offre une perspective historique expliquant le développement des règles relatives aux modifications constitutionnelles concernant le Sénat et les origines de la controverse qui a été soumise à la Cour. Afin de trancher la controverse, la Cour suprême a dû, pour la première fois depuis l’adoption de la constitution de 1982, préciser son interprétation de la formule de modification de la constitution. Se fondant sur le concept d’«architecture de la constitution» et, implicitement, sur une vision de la fédération canadienne comme un pacte, la Cour a interdit au gouvernement fédéral d’agir unilatéralement. La réforme du Sénat, si elle a lieu, devra donc faire l’objet d’une entente entre le gouvernement fédéral et les provinces.
