Abstract
L’acte de juger peut-il être envisagé en dehors de toute référence aux autres sources de la normativité sociale ? Si la théorie du droit tend depuis Kelsen à conceptualiser une position à mi-chemin entre l’altérité et la clôture du champ judiciaire, une approche plus empirique de l’acte de juger permet d’inventorier un certain nombre de faits susceptibles de favoriser une réévalutation des conditions concrètes de l’activité judiciaire. Ces constats ouvrent la porte à une définition plus réflexive de l’acte de juger. L’analyse sociologique de l’activité judiciaire trace ainsi la voie d’une redéfinition de l’acte de juger comme modalité du lien social. L’activité judiciaire apparaît alors comme un des espaces où peut se poursuivre le débat sur les conditions de la vie collective.
