Abstract
Da die EG nicht für das Streik- und Aussperrungsrecht zuständig ist, blieb lange Zeit unerörtert wie sich die europäische Integration auf das Arbeitskampfrecht auswirkt. Diese Thematik hat dadurch an Aktualität gewonnen, dass das Recht auf kollektive Maßnahmen in Art. 28 der EU-Grundrechtecharta zum Kanon der Gemeinschaftsgrundrechte gezählt wird. Mit dem Vertrag von Lissabon soll die Chartabestimmung demnächst verbindlich gemacht werden. Unterdessen hat der EuGH das Grundrecht auf kollektive Maßnahmen in den Rs. Viking und Laval bereits als "festen Bestandteil" des Gemeinschaftsrechts anerkannt.Adam Sagan untersucht vor diesem Hintergrund aus grundrechtsdogmatischer Perspektive die Herleitung, den Schutzbereich und die Möglichkeiten zur Beschränkung des Gemeinschaftsgrundrechts auf kollektive Maßnahmen, einschließlich der Frage, inwiefern die EG und die Mitgliedstaaten daran gebunden sind. Anschließend werden die praktischen Auswirkungen des Gemeinschaftsgrundrechts auf kollektive Maßnahmen auf europäischer, transnationaler und einzelstaatlicher Ebene aufgezeigt. Besondere Beachtung findet dabei die Frage, ob im Rahmen des Sozialen Dialogs auf Gemeinschaftsebene gesamteuropäische Arbeitskämpfe als zulässig anzusehen sind
