Abstract
Contre une propension aux conclusions généralisantes, ce texte propose de restituer aux relations entre droit et morale toute leur complexité. Choisissant comme angle d’approche la notion de responsabilité, et comme méthode la mise en perspective historique et sociologique, il évoque différents espaces au travers desquels se reconfigurent leurs relations : responsabilité sans faute, sollicitude à l’égard des victimes, inflation des connaissances conduisant à ce que l’ignorance n’excuse plus, recours au thérapeutique dans l’interprétation de l’action, conditionnalisation des droits sociaux. Dans chacun de ces exemples se décèle une réélaboration des relations entre droit et morale sans que pourtant ne puisse jamais s’en dégager de tendance lourde et univoque.
