Abstract
Cette étude a pour objet de démontrer qu’un des effets, peut être le plus insoupçonné, de la reconnaissance constitutionnelle des droits ancestraux des peuples autochtones est de mettre à mal l’hégémonie du territoire dans notre manière de penser la gouvernance autochtone contemporaine. Il s’agit ici de faire valoir que le régime des droits ancestraux mis en place par la Cour suprême en s’appuyant sur l’article 35 de la Loi constitutionnelle de 19821 fait apparaître les prémices d’un véritable ordre autonome autochtone fondé en grande partie sur le principe de personnalité – c’est-à-dire sur le rattachement personnel des individus au groupe – plutôt que sur le principe de territorialité qui, depuis l’avènement de l’État, fonde la puissance publique sur le contrôle d’un espace linéairement circonscrit.
