The 5-GHz spectrum for licensed exempt devices is exclusively available in the US, Canada, Japan, and Europe (HiperLAN devices only). Australia is now starting to consider making an assignment. The biggest challenge for the 5-GHz wireless LAN industry is that the current permitted power in the 5-GHz spectrum is being challenged by primary users. Primary users, in particular users from the satellite industry, have a very experienced lobbying machine compared with the highly disorganized IT industry. The ITU-R has included an agenda item in World Radiocommunication Conference 2003 (WRC 2003) for harmonization of the spectrum. They also have two agenda items for studies on spectrum sharing between mobile devices and primary users. This chapter addresses the current issues and regulatory aspects of the 5-GHz spectrum allocation in the US, Europe, and the rest of the world.
