Abstract
Plus qu'un droit fondamental, l'association constitue pour l'être humain une nécessité, fait constate depuis des siècles par les États démocratiques du monde entier. Bien que les législateurs canadiens et québécois reconnaissent le droit a la liberté d'association dans une multitude de sphères de l'activité humaine, c'est au chapitre des relations de travail que celui-ci suscite le plus de débats. Dans le cadre de la présente thèse de maîtrise, nous proposons donc d'examiner l'impact que peut avoir cette liberté constitutionnelle relativement au droit du travail du personnel cadre oeuvrant au Québec. La Cour suprême a défini à plusieurs occasions, depuis l'adoption de la Charte canadienne des droits et libertés, la nature et la portée de la liberté d'association dans le domaine des relations de travail. Malgré une littérature abondante sur le sujet, la situation des membres du personnel d'encadrement, qui sont exclus des dispositions du Code du travail, n'a toujours pas fait, à notre connaissance, l'objet d'une étude spécifique. À la lumière des récents arrêts de la Cour suprême portant sur cette liberté fondamentale, notre étude vise principalement à évaluer quelle signification revêt le droit d'association pour les cadres québécois.
