Abstract
Nach fast 150 Jahren hat Rumänien ein neues Zivilgesetzbuch. Das bereits2009 verabschiedete ZGB ist am 1. Oktober 2011 in Kraft getreten. Dieses neue ZGB folgt dem monistischen Modell des Privatrechts, indem es das Handelsgesetzbuch mit einbezieht. Es verzichtet somit auf die bisherige klassische Trennung des rumänischen Rechts zwischen den zivilrechtlichen und den handelsrechtlichen Verhältnissen. Das legistische Werk beschränkt sich nicht auf eine Rekompilation bisher bestehender Vorschriften, sondern enthält auch wesentliche neue Regelungen. Dabei wird das ZGB unter Einbeziehung der Erkenntnisse jüngster Judikatur an die aktuellen Wirtschaftsverhältnisse angepasst, wobei nicht nur das französische Vorbild, sondern auch Erfahrungen aus dem Zivilgesetzbuch von Québec herangezogen werden. Das Inkrafttreten eines neuen rumänischen Zivilgesetzbuches mit der Neugestaltung des rumänischen Zivil- und Unternehmensrechts war Anstoß für dieses Buchprojekt. Das Thema eignet sich hervorragend, um einerseits die komplexen schuldrechtlichen Aspekte, die bei einem Eigentümerwechsel auftreten, und andererseits die sachenrechtlichen Aspekte der Eigentumsübertragung in einem immer noch sehr stark französisch geprägten Zivilrechtssystem, zu erörtern
