In this article, we aim to explore theoretical and practical aspects of the legal nature of the membership contract at the risk of contractual imbalance from the perspective of French law, which has proven to be a source of inspiration for other legal systems. Throughout life, people are often faced with the need to enter into membership contracts to satisfy their basic needs, but often acting as consumers of services and products, professionals, contrary to good faith, submit contracts written unilaterally in their favor, creating a significant contract imbalance to the detriment of consumers. As a result, the main purpose of this article is to demonstrate that the membership contract is a source of contractual imbalance, which comes to create an excessive economic advantage in favor of professionals to the detriment of consumers.
