Abstract

fetched live from OpenAlex

Problem statement. The study of the legal systems of the world in modern historical conditions requires the improvement of their classification. He is due, among other things, to the impact of globalization on the law, because of which on the legal map of the world appear legal systems, which are difficult to attribute to any of the existing types. In addition, within certain types of legal systems, there is an internal differentiation, which should be reflected in the scientific typology. This applies in particular to the development of mixed legal systems. The purpose of the study is to substantiate the thesis of the existence of two types of mixed legal systems and to reveal their features. For this purpose, the following methods were used: hermeneutic – to clarify the essence of scientific approaches to understanding the mixed legal system; comparative – to reveal the differences between existing models of mixed legal systems; formal-logical – to formulate their criteria for the classification of mixed legal systems and to distinguish their types. Results. It has been established that during the last hundred years the attitude of scholars to the mixed type of legal systems has significantly changed. If earlier most authors perceived this type as atypical and exotic, today its existence is practically beyond doubt. Moreover, some authors even argue that in modern conditions, all legal systems are mixed in nature. There are also many attempts to classify mixed legal systems, but they lack clarity of criteria. It is proposed to distinguish between hybrids and pluralistic among mixed legal systems, the differences between them are outlined. Conclusions. The current state of comparative legal research allows us to point out significant differences between hybrid and pluralistic varieties of mixed legal systems. The first type is formed due to the intertwining of norms and institutions of different types of legal systems (primarily – Romano-Germanic and Anglo-American) in a certain territory; the second type provides for the parallel coexistence in the state of different regulations addressed to different groups of the population.

Not calibrated prevalence, not ground truth. Human validation pending. The Gemma side is a direct model label for every work in the frame, read from the title-only record. The Codex side is a classifier learned from the 10,348 direct Codex labels and calibrated to design-weighted sample rates; fields without enough sample support carry no Codex call. Candidate is the union of the two sides; consensus is their intersection. These outputs are machine_predicted_unvalidated and are not human labels.

Machine scores (provisional)

The two teacher heads of the student model, read on this work. A score orders the frame for review; it never asserts a category, and the validation status ships verbatim with every row.

Baseline scores from an immature model (maturity gate not passed, 7 training rounds). Scores rank; they never assert a category.
