Protéger les personnes « en situation de vulnérabilité » est - selon l’expression de Philippe Malaurie - « l’honneur du droit ». C’est aussi un impératif qui doit guider les politiques publiques de nos sociétés occidentales vieillissantes... En France, l’arsenal législatif, après une longue période de stabilité, a été profondément remanié en 2007. Parmi les professionnels du secteur, les usagers, les universitaires comme les praticiens du droit, nombreux sont ceux qui aujourd’hui dénoncent les imperfections du système français. L’objectif du colloque proposé est de penser les évolutions à venir du droit français, qu’elles soient déjà en discussion ou uniquement à l’état de propositions doctrinales, sous l’éclairage de l’expérience québécoise.
