Abstract
Dem Ordinarius kommen im Vermögensrecht der Institute des geweihten Lebens an verschiedenen Stellen bestimmte Kompetenzen zu. In klerikalen Instituten päpstlichen Rechts sind die Ordinarien nach c. 134 § 1 die höheren Oberen der Institute, gemäß des von Papst Franziskus am 18. Mai 2022 ausgestellten Reskripts an das DIVCSVA auch dann, wenn es sich ausnahmsweise um Laien handelt. Die Institute aber, die keinen eigenen Ordinarius haben, stellen die mit dem Ordinarius verbundenen Regelungen vor besondere Herausforderungen hinsichtlich ihrer Autonomie gemäß c. 586 § 1. Insbesondere wenn vom Ordinarius proprius die Rede ist (c. 1265 § 1, c. 1288 und c. 1302 § 3), bleibt teilweise schon im Text und auch in der kirchenrechtlichen Literatur unklar, wer eigentlich gemeint ist.
