Abstract
Her Honour reviews the use of mediation in Victoria and explains the benefits of mediation while noting the various risks associated with judge-led mediation. Her Honour describes the underlying framework of the Canadian ‘judicial dispute resolution approach’ which seeks to minimise the risks associated with judicial involvement in alternative dispute resolution. Finally, Her Honour explores the utility of other alternative dispute resolution processes including early neutral evaluation.
