Abstract
L’analisi dei profili fiscali del procedimento di mediazione delle controversie civili e commerciali necessita l’approfondimento del regime di tassazione dei compensi percepiti dall’organismo di mediazione e, per tale tramite, dal singolo mediatore, tanto per ciò che concerne l’imposizione diretta quanto per quella indiretta, nonché della disamina del regime tributario al quale assoggettare l’attività svolta dagli enti di formazione. Sul piano tributario, le attività svolte dagli organismi di mediazione, dal singolo mediatore e dagli enti di formazione, in quanto prestazioni di servizi, assumono rilievo sia ai fini delle imposte sui redditi, che dell’IVA; ove poi sia possibile individuare un’autonoma organizzazione, viene in rilievo anche l’IRAP.
