Kaipaako sota yhtä miestä? : maanpuolustusvelvollisuus ja vakaumuksellinen aseistakieltäytyminen

Abstract
Suomi on valinnut puolustusratkaisukseen pakollisen asevelvollisuuden. Asevelvollisuus on kuitenkin vaativa järjestelmä ylläpitää samalla, kun valtio sitoutuu puolustamaan ihmisoikeuksia sekä noudattamaan oikeusvaltion periaatteita. Suomi onkin pitkään saanut moitteita asevelvollisuusjärjestelmänsä tiettyjen piirteiden takia. Ase- ja maanpuolustusvelvollisuus nousevat säännöllisesti yleiseen keskusteluun, kun pohditaan järjestelmän uudistamista, esimerkiksi säännöllisesti nousevan kansalaispalvelusajatuksen kautta tai kun pohditaan järjestelmän sukupuolittuneisuutta ja siten sen, ainakin tulkinnallista, epäyhdenvertaisuutta. Mikään ei kuitenkaan ole nostanut lähihistoriassamme maanpuolustusvelvollisuuskeskustelua niin otsikoihin, kuin vuoden 2018 alussa tullut Helsingin hovioikeuden päätös vapauttaa siviilipalveluksesta kieltäytyjä vetoamalla Jehovan todistajien vapautukseen kaikesta palveluksesta. Tämä tutkielma tutkii sitä tilannetta, joka oli voimassa Jehovan todistajien vapautuksen päätyttyä ja tutkii, onko Suomen asevelvollisuusjärjestelmä Suomen oman perustuslain ja Suomea velvoittavien kansainvälisten sopimusten velvoitteiden mukainen. Tutkimus on tehty lainopin metodein. Lopputuloksena on havaittu, että Suomella on ongelmakohtia, mutta ne ovat myös korjattavissa.
