Abstract
The integration of the trusts in Quebec civil law is a good indicator of the evolution of Quebec juristic thinking. Even if some scholars have tried to recognize a civilian provenance to the institution, taking into account the context in which trusts developed in the 19th century in Quebec, it is hard to deny the fiducie’s common law underpinnings. The Quebec trust illustrates the problems posed by the integration in a given legal system of a foreign institution, i. e. acculturation. The institution can blend into the receiving system, substantially transform it or undergo a form of hybridization. All of these models have been used, either independently or concurrently, in order to define the field of application and the legal regime of the fiducie. Judges and scholars alike have struggled with the institution for decades, forcing jurists to reshape the civil law in order to propose, albeit not without some difficulty, a form of harmonization of the legal traditions.
