Le recenti innovazioni del complesso disciplinare relativo alla materia bancaria e finanziaria suggeriscono una rivisitazione di taluni significativi aspetti della stessa. L’indagine approfondisce, pertanto, la nuova regolazione del «gruppo bancario» alla luce delle disposizioni di recepimento di alcune importanti direttive europee (CRD IV e BRRD), nonché delle riforme legislative che hanno mutato l’assetto morfologico di alcune categorie di enti creditizi. Viene sottolineato, quindi, il superamento della previgente normativa incentrata sul rapporto tra direzione unitaria ed interesse di gruppo, a fronte dell’emersione di una nuova struttura di tale entità organizzativa fondata su più intensi legami tra gli aderenti, quali è dato evincere dagli accordi di sostegno finanziario infragruppo e dal cross-guarantee scheme che, nel gruppo bancario cooperativo, reca elementi solidaristici e di profonda compenetrazione patrimoniale
