Abstract
L’articolo ha ad oggetto la recente pronuncia della Corte di giustizia UE relativa al caso Walz c. Clickair SA, nella quale la Corte, esaminando per la prima volta in via diretta la Convenzione di Montreal per l’unificazione di alcune norme relative al trasporto aereo internazionale, si pronuncia sulla definizione di “danno” applicabile al regime di responsabilità del vettore aereo nel trasporto di persone e bagagli. In parti-colare, la Corte UE fornisce un’interpretazione unitaria della nozione di “danno”, comprensiva tanto del dan-no morale quanto di quello materiale. L’articolo, una volta inquadrata la posizione della Convenzione di Montreal nell’ordinamento dell’Unione e richiamata la precedente giurisprudenza della Corte di giustizia ad essa relativa, analizza la soluzione fornita dalla Corte e le sue argomentazioni, valutandone le ricadute sul regime convenzionale e l’ortodossia alla luce del diritto internazionale.
