Abstract
Les exigences d’efficacité sont clairement établies pour l’administration publique québécoise avec l’entrée en vigueur de la Loi sur l’administration publique en 2000. Il y a désormais mise en œuvre d’une nouvelle gestion publique par le biais du cadre de gestion axé sur les résultats et sur la performance. Ce projet de fin d’études cherche à mettre en lumière l’interaction entre la logique managériale adoptée par les tribunaux administratifs et les apports de la justice participative. Nous tentons de discerner l’influence qu’exerce cette dualité sur l’esprit du processus de conciliation. En analysant les débats parlementaires et les publications de reddition de comptes des trois principaux tribunaux administratifs du Québec, notre synthèse expose la préséance accordée aux objectifs de diminution des délais sur d’autres objectifs au cœur des processus participatifs tels que les principes de préparation adéquate, de dialogue direct, de souplesse et d’adaptabilité, et d’autodétermination.
